Allgemeine Geschäftsbedingungen (AGB) für den Verkauf von Veranstaltungstickets
§ 1 Geltungsbereich
- Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge über den Verkauf von Veranstaltungstickets, die zwischen Dr. Cyril Mongis (im Folgenden "Veranstalter") und den Kunden abgeschlossen werden.
- Der Verkauf erfolgt ausschließlich an Verbraucher im Sinne des § 13 BGB. Ein Weiterverkauf der Tickets zu gewerblichen Zwecken ist untersagt.
- Abweichende Allgemeine Geschäftsbedingungen des Kunden werden nicht anerkannt, es sei denn, der Veranstalter stimmt ihrer Geltung ausdrücklich zu.
§ 2 Vertragsabschluss
- Die Präsentation der Tickets auf der Webseite stellt kein rechtlich bindendes Angebot dar, sondern eine unverbindliche Aufforderung zur Abgabe einer Bestellung durch den Kunden.
- Durch Anklicken des Buttons "Subscribe to this event and pay" gibt der Kunde ein verbindliches Angebot zum Kauf des gewählten Tickets ab.
- Der Vertrag kommt zustande, wenn der Veranstalter die Bestellung des Kunden durch eine Bestätigungs-E-Mail annimmt.
§ 3 Preise und Zahlung
- Alle angegebenen Preise verstehen sich als Endpreise, inklusive der gesetzlichen Mehrwertsteuer (falls anwendbar).
- Die Bezahlung erfolgt über die auf der Webseite angebotenen Zahlungsmethoden.
- Der Kunde ist verpflichtet, den Gesamtbetrag unmittelbar nach Vertragsschluss zu zahlen.
§ 4 Lieferung und Ticketübermittlung
- Die Tickets werden dem Kunden nach Zahlungseingang per E-Mail in Form eines Links zugesandt.
- Der Kunde ist verpflichtet, die Tickets auf Richtigkeit der Angaben (Datum, Veranstaltungsort, etc.) zu überprüfen und etwaige Fehler unverzüglich mitzuteilen.
§ 5 Rücktritt und Erstattungen
- Ein Widerrufsrecht des Kunden besteht gemäß § 312g Abs. 2 Nr. 9 BGB nicht, da es sich um Dienstleistungen im Zusammenhang mit Freizeitbetätigungen handelt, die zu einem spezifischen Termin oder Zeitraum erbracht werden.
- Eine Erstattung des Ticketpreises ist nur im Falle einer Absage der Veranstaltung durch den Veranstalter möglich. Weitere Ansprüche sind ausgeschlossen.
§ 6 Haftung
- Der Veranstalter haftet uneingeschränkt für Vorsatz und grobe Fahrlässigkeit. Bei einfacher Fahrlässigkeit haftet der Veranstalter nur für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie für Schäden aus der Verletzung wesentlicher Vertragspflichten (Kardinalpflichten).
- Die Haftung ist im Fall einfacher Fahrlässigkeit auf den vorhersehbaren, typischerweise eintretenden Schaden begrenzt.
§ 7 Datenschutz
- Der Veranstalter erhebt, verarbeitet und nutzt die personenbezogenen Daten des Kunden ausschließlich zur Abwicklung des Vertrags.

§ 8 Schlussbestimmungen
- Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.
- Sollte eine Bestimmung dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
- Gerichtsstand ist der Wohnsitz des Veranstalters, sofern der Kunde keinen allgemeinen Gerichtsstand in Deutschland hat.

General Terms and Conditions (GTC) for the Sale of Event Tickets
§ 1 Scope
- These General Terms and Conditions (GTC) apply to all contracts for the sale of event tickets concluded between Dr. Cyril Mongis (hereinafter referred to as "Organizer") and the customers.
- The sale is exclusively made to consumers within the meaning of § 13 BGB. The resale of tickets for commercial purposes is prohibited.
- Diverging terms and conditions of the customer will not be recognized unless the Organizer explicitly agrees to their validity.
§ 2 Conclusion of Contract
- The presentation of tickets on the website does not represent a legally binding offer but an invitation for the customer to submit an order.
- By clicking the "Order with obligation to pay" button, the customer submits a binding offer to purchase the selected ticket.
- The contract is concluded when the Organizer accepts the customer's order by sending a confirmation email.
§ 3 Prices and Payment
- All prices are final prices, including statutory value-added tax (if applicable).
- Payment is made via the payment methods offered on the website.
- The customer is obligated to pay the total amount immediately after the conclusion of the contract.
§ 4 Delivery and Ticket Transmission
- The tickets will be sent to the customer via email in the form of a link after payment has been received.
- The customer is responsible for verifying the accuracy of the ticket details (date, venue, etc.) and must report any errors immediately.
§ 5 Withdrawal and Refunds
- The customer has no right of withdrawal according to § 312g para. 2 no. 9 BGB, as the service concerns leisure activities provided at a specific date or time.
- A refund of the ticket price is only possible if the event is canceled by the Organizer. Further claims are excluded.
§ 6 Liability
- The Organizer is liable without limitation for intent and gross negligence. In the case of slight negligence, the Organizer is only liable for damages resulting from injury to life, body, or health, as well as for damages resulting from the breach of essential contractual obligations (cardinal obligations).
- In cases of slight negligence, liability is limited to foreseeable, typically occurring damages.
§ 7 Data Protection
- The Organizer collects, processes, and uses the customer's personal data exclusively for the fulfillment of the contract.

§ 8 Final Provisions
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- If any provision of these GTC is invalid, the validity of the remaining provisions remains unaffected.
- The place of jurisdiction is the residence of the Organizer, provided the customer has no general place of jurisdiction in Germany.
